WEAPON CRIMES INFORMATION:
Cases involving weapons are taken more seriously by prosecutors.
Even in cases where the individual simply possessed a weapon,

the individual may have simply failed to properly carry or transport the
weapon.

The following section provides general information about some crimes involving weapons:
Carrying concealed weapons - This occurs when a person, who is not authorized to do so,
carries a concealed weapon or electric weapon or device on or about his or her person commits a
misdemeanor of the first degree. This offense is a felony of the third degree punishable by up to 5
years in State Prison.
Some exceptions to this statute are that it is not a violation of this section for a person to carry for
purposes of lawful self-defense, in a concealed manner:
- A self-defense chemical spray.
- A nonlethal stun gun or remote stun gun or other nonlethal electric weapon or device which
does not fire a dart or projectile and is designed solely for defensive purposes.
This law, however, does not preclude any prosecution for the use of an electric weapon or device
or remote stun gun or self-defense chemical spray during the commission of any criminal
offense.
Improper exhibition - This occurs when a person having or carrying any dirk, sword, sword cane,
firearm, electric weapon or device, or other weapon, in the presence of one or more persons,
exhibits the same in a rude, careless, angry, or threatening manner, not in necessary self-
defense. A violation of this statute is a misdemeanor of the first degree punishable by up to 1 year
in the county jail.
Discharging firearm in public - Essentially, it is unlawful for any person to knowingly discharge a
firearm in any public place or on the right-of-way of any paved public road, highway, or street or
whosoever knowingly discharges any firearm over the right-of-way of any paved public road,
highway, or street or over any occupied premises. A violation of this law is a First Degree
misdemeanor punishable by up to 1 year in the county jail.
If, however, the accused was the occupant of any vehicle and knowingly and willfully discharged
any firearm from the vehicle within 1,000 feet of any person, they are committing a felony of the
second degree punishable by up to 15 years in State Prison. In addition, any driver or owner of any
vehicle, whether or not the owner of the vehicle is occupying the vehicle, who knowingly directs any
other person to discharge any firearm from the vehicle commits a felony of the third degree
punishable by up to 5 years in State Prison.
