While there are many different types of drug crimes, these cases
primarily consist of three different types of offenses: possession,

The following section provides some general information about drug offenses:
Possession - These cases consist of an individual unlawfully possessing an illegal drug.
Depending on the type of drug and amount, the individual could be facing either a felony or
misdemeanor. The following three types of possession cases are common in Florida.
- Possession of cannabis less than 20 grams is a first degree misdemeanor punishable by up
to 1 year in the county jail. A conviction for this offense also results in a loss of a persons
drivers license for 2 years.
- Possession of Drug Paraphernalia is a first degree misdemeanor punishable by up to 1 year
in the county jail. Almost any item can be termed drug paraphernalia when used in
connection with drugs, including: pipes, baggies, cigars, rolling paper and bongs, and these
items are legal when they do not contain drug residue or are not being used in connection
with illegal drugs.
- Possession of cocaine less than 28 grams is a third degree felony punishable by up to 5
years in State Prison.
In many of the possession cases where there is an arrest, defenses exist that may result in the
dismissal of the charges altogether.
Sale or Possession with Intent to Sell - These cases consist of an individual unlawfully selling
or possessing with intent to sell a controlled or illegal substance. Sale of Cannabis is a third
degree felony, and sale of cocaine is a 2nd degree felony, however in certain cases, such as
sale within a 1000 feet of a school, minimum mandatory sentences may apply and the penalties
will increases. A minimum mandatory sentence prevents a person from being sentenced to less
than the minimum provided by statute if they are found guilty.
Trafficking - These cases are different from other drug offenses because of the potential
penalties and the level of investigation that is usually involved on the part of law enforcement.
Trafficking, simply put, is the unlawful possession of large quantities of an illegal drug. For
cannabis the amount is in excess of 25 pounds or 300 or more cannabis plants, and for cocaine
the amount is 28 grams or more. In trafficking cases mandatory minimum penalties are severe.

Trafficking cases where the person knowingly brings into the state 300 kilograms or more of
cocaine, and knows that the probable result of such importation would be the death of any
