The following section provides some general information about burglary and robbery offenses:

Burglary - involves the act of entering a dwelling, a structure, or a conveyance with the intent to
commit an offense therein, when the premises are not open to the public or the defendant is not
licensed or invited to enter.  Even if the defendant is licensed or invited entry, a burglary can be
committed by remaining in the dwelling, structure, or conveyance: surreptitiously, with the intent to
commit an offense therein; or after permission to remain therein has been withdrawn, with the
intent to commit an offense therein; or to commit or attempt to commit a forcible felony.

The level of offense for a burglary can change depending on the alleged circumstances involved in
the individual case.  If for instance during the commission of a burglary of a residence, the accused
commits a assault or battery, then the burglary may be charged as a 1st Degree Felony punishable
by up to life in State Prison.  The same offense  without an assault or battery would be a 2nd
Degree Felony punishable by up to 15 years in prison.  

Also, the type of structure will also affect the level of offense.  A burglary of residence is a 2nd
Degree Felony punishable by up to 15 years in State Prison versus a burglary of a nonresidential
structure or business which is a 3rd Degree Felony punishable by up to 5 years in State Prison.   

Stealthy Entry - In a trial on the charge of burglary, proof of the entering or of the attempt to enter
such structure or conveyance at any time stealthily and without consent of the owner or occupant
thereof is prima facie evidence of entering with intent to commit an offense.

Possession of Burglary Tools - In many burglary cases, an additional offense of possession of
burglary tools is charged.  This offense occurs when the Defendant has in his or her possession
any tool, machine, or implement with intent to use the same, or allow the same to be used, to
commit any burglary or trespass and is a 3rd Degree Felony punishable by up to 5 years in State
Prison

Robbery - occurs when an individual steals money or other property and when in the course of the
taking the money or property uses force, violence, assault, or puts the person in fear.  

If in the course of committing the robbery the offender carried a firearm or other deadly weapon,
then the robbery is a felony of the first degree, punishable by up to life in State Prison.  If in the
course of committing the robbery the offender carried no firearm, deadly weapon, or other weapon,
then the robbery is a felony of the second degree punishable by up to 15 years in State Prison.
