The following section provides some general information about assault and battery offenses:

Assault - is an intentional, unlawful threat by word or act to do violence to the person of another,
coupled with an apparent ability to do so and an act which creates a well-founded fear in such other
person that such violence is imminent.   An assault is a 2nd Degree Misdemeanor punishable by
up to 60 days in the county jail.

Aggravated Assault - is an assault with a deadly weapon without the intent to kill; or with an intent
to commit a felony.  An aggravated assault is a 3rd Degree felony punishable by up to 5 years in
State prison.

Battery - consists of a person actually or intentionally touching or striking another person against
the will of the other; or intentionally causing bodily harm to another person.  In some cases, the
alleged crime may be that of a simple push which left no mark or physical injury on the victim.  

A battery is usually a 1st Degree misdemeanor punishable by up to 1 year in the county jail.   If the
individual has a prior conviction for battery, aggravated battery, or felony battery, however, the crime
may be charged as a 3rd Degree felony punishable by up to 5 years in State prison.

Felony Battery - A person commits felony battery if he or she: actually and intentionally touches or
strikes another person against the will of the other; and causes great bodily harm, permanent
disability, or permanent disfigurement.  A Felony Battery is a 3rd Degree felony punishable by up to
5 years in State Prison.

Aggravated Battery -  A person commits an aggravated battery when in committing the crime of
battery they:

  • Intentionally or knowingly causes great bodily harm, permanent disability, or permanent
    disfigurement.
  • Uses a deadly weapon.
  • if the offender knew or should have known that the victim was pregnant, and the person who
    was the victim of the battery was actually pregnant at the time of the offense.  

An aggravated battery is a 2nd Degree felony punishable by up to 15 years in State Prison.
